The University of Dubuque's Safety and Security Department prepares this report in compliance with State and Federal Law, and the Clery Act specifically. The Student Right-to-Know and Campus Security Act (Public Law 101-542) was signed into law by President Bush on November 8, 1990. Title II of the Act, the Crime Awareness and Campus Security Act (Campus Security Act), amended section 485 of the Higher Education Act of 1965 (HEA) by adding campus crime statistic and security policy disclosure provisions for all colleges and universities that receive federal student aid. These provisions were amended in 1992, and significantly amended again on October 7, 1998, when President Clinton signed into law the Higher Education Amendments of 1998 (Public Law 105-244). The Campus Security Act (the Act) is currently cited as 20 USC 1092(f) or section 485(f) of the Higher Education Act. The 1998 amendments renamed this subsection of the Higher Education Act the "Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act" (the Act). In October 29, 2009 the reporting and disclosure of information was again significantly amended and went into effect July 01, 2010. The new updates 34 CFR 668.41(e), 34 CFR 668.46, and 34 CFR 668.49 require the posting of policies and procedures as well as listings of annual fire safety report, annual fire drill, and a fire log.
The Act requires colleges and universities to distribute statements of policy regarding campus security and crime prevention, and statistics concerning specific types of crimes, to all current students and employees, and to any prospective student and employee upon request, beginning September 1, 1992, and by October 1 of each year thereafter. Noncompliance with the requirements of the Act will affect an institution's continued participation in the Title IV student financial assistance programs authorized by the Higher Education Act of 1965, as amended. Moreover, if it is determined that an institution of higher education has substantially misrepresented the number, location, or nature of the crimes required to be reported under the Act, the Department of Education may impose a civil penalty upon the institution. The general policies and procedures that follow have been formulated to facilitate The University of Dubuque's implementation of the requirements of the Act.
This report is prepared by the University's Safety and Security Department in cooperation with local law enforcement agencies and the Office of Student Life. Each entity provides updated information on its educational efforts and programs to comply with the Act. The University of Dubuque prepares this report in compliance with the Jeanne Clery Disclosure of Campus Security Policy and Crime Statistics Act.
The University of Dubuque's Annual Security Report provides important information about the safety and security at the University of Dubuque. All campus crime statistics required by the Clery Act are provided, including the number of persons referred for campus disciplinary action. Information about campus crime prevention and safety awareness programs are also provided. This report includes statistics for the previous three years concerning reported crimes that occurred on campus, in certain off-campus buildings or property owned or controlled by the University of Dubuque, and on public property within, or immediately adjacent to and accessible from, the campus. This report also includes institutional policies concerning campus security, such as policies concerning alcohol and drug use, crime prevention, the reporting of crimes, sexual assault, and other matters.
Each year, an email notification is made to all enrolled students, faculty and staff. This notification provides information on how to access the Annual Security report online; employees who do not have a campus email address receive a postcard through campus mail which provides similar information. As required by federal law, University of Dubuque's yearly crime statistics for this report are compiled on a calendar-year basis in accordance with the definitions of crimes provided by the FBI for use in the Uniform Crime Reporting (UCR) system. The report includes statistics for the previous three years concerning reported crimes that occurred on campus and its surrounding areas at the University of Dubuque by designated campus officials (including but not limited to directors, deans, department heads, residence life staff, dean of students staff, advisors to students, and athletic coaches). In addition, these statistics also include number of people referred for campus disciplinary action for categories required under the Clery Act, including liquor and drug law violations, and illegal weapons possession. Statistical information for certain off-campus locations or property owned or controlled by the University of Dubuque as well as public property within or immediately adjacent to and accessible from the campus are collected or requested from police departments. For statistical purposes, crime statistics reported by any of these sources are recorded in the calendar year during which the crime was reported. To report a crime or a non-emergency from an on-campus phone, call 3333 or from outside the University phone system at 3333 or (563) 589-3333. The University of Dubuque recommends pre-programming of cell phones with the University of Dubuque dispatch number 3333 or (563-589-3333). Dispatchers are available 24 hours a day, 7 days a week to answer your call.
As an added security measure, blue emergency phones are located at strategic points on campus. These phones are easily identified by their blue boxes topped with blue lights. When the red emergency button is pushed, the caller is in immediate contact with the University Safety and Security Department (if the Dubuque Police are required the caller may contact the police direct by dialing 9-911 or the University Safety and Security Department would contact the police ).
When calling for either emergency or non-emergency service, be prepared to:

If possible, stay on the line unless otherwise advised by the dispatcher. If assistance is required from off campus, the dispatcher will summon the appropriate police, fire and/or medical service.
To report a crime that occurs at an off-campus location, contact the appropriate local police department (Dubuque Police Department 911). In the case of an emergency it is always best to dial 911 and follow the procedures outlined above. The following statistics are published in accordance with the standards and guidelines used by the Federal Bureau of Investigation Uniform Crime Reporting Handbook and the federal law regarding The Clery Act.
The number of victims involved in a particular incident is reported under the following crime classifications: Murder/Non-Negligent Manslaughter, Negligent Manslaughter, Forcible and Non- Forcible Sex Offenses, Aggravated Assault. For example, if an aggravated assault occurs and there are three victims, this would be counted as three aggravated assaults on the crime statistics chart.
The number of incidents involving a particular offense is indicated for the following crime categories (includes one offense per distinct operation): Robbery, Burglary, Larceny, and Arson. For example, if five students are walking across campus together and they are robbed, this would count as one instance of robbery in the crime statistics chart.
In cases of motor vehicle theft, each vehicle stolen is counted.
In cases involving Liquor Law, Drug Law, and Illegal Weapons violations, each person who is arrested is indicated in the arrest statistics. If an arrest includes offenses for multiple liquor or drug law violations, the more egregious offense will be counted. The statistics captured under the Referred for Disciplinary Action section for Liquor Law, Drug Law, and Illegal Weapons violations indicate the number of people who are referred to the Judicial System by the Dean of Students' Office and found responsible for violating those specific laws. Being found responsible includes a referral that results in disciplinary action that is initiated by the Judicial System, and a record of the action are kept on file.
Beginning in 2005, Hate Crime statistics are separated by their category of prejudice. Statistics for Hate Crimes are counted in each specific Clery reportable crime category and therefore, are part of the overall statistics reported for each year. The only exception to this is the addition of a bias-motivated simple assault resulting in bodily injury; the law requires that this statistic be reported as a hate crime even though there is no requirement to report the crime in any other area of the compliance document.
Unless otherwise indicated, all statistics are from incidents that were reported to the University Safety and Security Department. "On Campus Residence Halls" is a subset of the "On Campus" crime category. The law requires institutions to break out the number of "on campus" crimes that occur in residential facilities.
The University Safety and Security Department is responsible for issuing Crime Alerts in compliance with the Clery Act. In the event a situation arises, either on or off campus, these alerts are issued to keep the campus community informed about safety and security matters. The decision to issue a Crime Alert is decided on a case by case basis in light of all the facts surrounding an incident, including factors such as the nature of the crime, the continuing threat to the campus community, and the possible risk of compromising law enforcement efforts. Crime Alerts are issued for specific crime classifications such as arson or hostile intruder. Crime Alerts will also be posted on the University web site. To issue a Crime Alert, the University Safety and Security Department informs the campus community via a campus-wide emergency notification, the UD ALERT SYSTEM by means of email, cell phone, and text/voice messages. The UD ALERT SYSTEM also contacts others that have been listed as emergency contacts. In addition to these Crime Alerts, UD ALERTS are issued to the campus community in the event of an immediate or ongoing threat to the community. UD ALERT SYSTEM is disseminated with the goal of notifying as many people as possible, as rapidly as possible, about active threats, such as bomb threats, snipers, dangerous chemical spills, etc. These alerts are sent via SMS Text Messages to individuals who subscribe to the UD ALERT SYSTEM. A method to alert the campus community about emergencies must be in place. University of Dubuque has implemented a widely-used UD ALERT campus emergency alert system that allows University officials to reach all students and employees with time-sensitive information during unforeseen events, emergencies, and significant emergencies or dangerous campus situations involving an immediate threat to the health and/or safety of students and employees. UD ALERT is powered by BlackBoard Connect.
In the event of a serious incident which poses an immediate threat to members of the University community, the University has various systems in place for communicating information quickly to those individuals. Upon confirmation of a significant emergency or dangerous situation involving an immediate threat to the health or safety of the students or employees occurring on campus, some or all of these methods of communication may be activated. These methods of communications may include activating UD ALERT, an emergency notification system utilizing email, text messaging and telephone voice messaging; or messages on the home page of University of Dubuque website.
Examples of emergency or crisis situations include, but are not limited to, the following:
· Terrorist attacks
· On-campus hostile intruder
· Imminent natural disasters
· Fires
· Serious facilities issues
· Imminent extraordinary weather conditions
Personal Contact Information for UD ALERTThe system uses voice, e-mail, and text messaging to broadcast pertinent information and, when appropriate, provides directions to those in the affected area(s). For each individual, UD ALERT can deliver one voice message to the phone number(s) (including non-cell and cell phones), e-mail address (es), and text message number(s) you have provided us. Students/Faculty and Staff should supply the information that is required on the Emergency Contact Information Form. Remember, the more information you give us, the more people will be contacted in the event of an emergency. Students and employees are advised to keep their personal telephone numbers, email address and text messaging information updated on the UD web portal to ensure receipt of emergency messages. One or more of these methods is used whenever the Director of Safety and Safety or another member of the University Crisis Management Team determines that a situation exists which constitutes an imminent threat to members of the campus community. Any and all contact information you provide, such as home telephone numbers, cell numbers, and e-mail addresses, may be used to notify you of an emergency or crisis that may affect you and/or the University community. Your emergency contact information may also be used to notify your designated emergency contact(s) of an emergency or crisis that may affect you and/or the University community.
What You Need to Do to Provide Your Emergency Contact Information 1. Providing Your Emergency Contact Information
If you have not already done so, please provide your most current contact information now by logging onto the web portal at http://intranet.dbq.edu/emergencycontactform.cfm and following the appropriate instructions below. The information you provide is kept
completely confidential and will only be used to provide updates to the UD ALERT system. To receive text messages, you will need to provide the
university with your mobile phone number. If you need to update your emergency contact information, log into the web portal, and make the appropriate
changes. You can change or update your contact information by logging onto the portal and filling out as many fields as possible.
If we do not have your current, accurate information, you won't be contacted regarding an emergency. Please verify the accuracy and completeness of your information on the following web portal:

Phone numbers and email addresses of parents or other persons identified by students or employees in official University registrar or employee records as emergency contact persons will be included in the UD ALERT system, and they may receive emergency messages as well. Your parent/spouse/friend will receive an UD Alert if you listed these persons and their phone numbers as your emergency contact. If you need to change your or your emergency contact's information, log into the portal at http://intranet.dbq.edu/emergencycontactform.cfm . The information in the Emergency Contact Form is kept completely confidential and will only be used to provide updates to the UD ALERT system.
When a potentially dangerous threat to the University community arises, UD ALERT SYSTEM will be issued to notify individuals of the threat in a timely manner. These Alerts will also inform the community of any recommended action to be taken. (See Timely Warning Policy). Based on the nature of the emergency, the responsibility for assessing the severity of the threat begins with the University's Crisis Management Teams (President, VP for Finance and Auxiliary Services, VP for Enrollment Management Marketing & University Relations, VP of Academic Affairs, VP and Dean of the Seminary, Dean of Student Life) and/ or the Office of the Safety and Security Department. Upon a determination by the University Crisis Management Team that a significant threat exists, the Department of Safety and Security will be notified to launch the emergency notification. The University will also post updates during a critical incident on at www.dbq.edu. Staff from the Office of the Senior Vice President for Enrollment Management, Marketing, and University Relations will have the responsibility for preparing and posting emergency message updates to the University of Dubuque homepage. In the event of confirmation of a threat involving imminent risk the Director of the Safety and Security Department or his designee may activate UD ALERT immediately, prior to notifying the University Crisis Management Team. The Director of Safety and Security plans, publicizes, and conducts a test of the emergency response and notification system each semester and maintains a record documenting each test, including a description of the exercise, the date, time and whether it was announced or unannounced.
The University shall do the following:
If a member of the University community has reason to believe that a student who resides in on-campus housing is missing, the University Safety and Security Department should be contacted immediately at 3333 or (563) 589-3333. In addition, you may also notify the Resident Life Department which must then notify the University Safety and Security Department immediately of a missing student. Immediately, an investigation will be initiated in order to attempt to locate the missing student. The University Safety and Security Department has a detailed and specific protocol for conducting a missing student investigation, utilizing a wide range of electronic resources as well as making personal contact with friends, classmates, co-workers and relatives. The Dubuque Police Department and the police department of the community where the missing student maintains a permanent address will be contacted within a 24 hour period. The person designated as the student's emergency contact will be notified by a member of the University Crisis Management Team no later than 24 hours after the student is determined to have been missing, and if the missing student is under the age of 21 a missing person notice will be posted on the national police information network. If the missing student is under the age of 18 and is not an emancipated individual, the University will notify the student's parent or legal guardian immediately after the University Safety and Security Department has determined that the student is been missing.
When registering the name of a person as an emergency contact through the online registration process, students also have the option to confidentially identify an individual to be contacted by the University in the event the student is determined to be missing. If the student has identified such an individual, the University of Dubuque will notify that person after the student is determined to have been missing.
It is the policy of the University of Dubuque that all crimes should be reported to the University Safety and Security Department. Anyone who is the victim or witness to a crime on campus is encouraged to promptly report the incident to the University Safety and Security Department. Due to the sensitive nature of certain types of crime, victims of sexual assault may choose to confidentially report crimes to the Dean of Students Office or to Residence Life staff. These reports are included in the annual crime statistics. The Dean of Students Office and the Resident Life Department are required to notify the University Safety and Security Department.
As a result of the negotiated rulemaking process which followed the signing into law of the 1998 amendments to 20 U.S.C. Section 1092 (f), clarification was given to those considered to be campus security authorities. Campus "Pastoral Counselors" and Campus "Professional Counselors," when acting as such, are not considered to be a campus security authorities and are not required to report crimes for inclusion in the annual disclosure of crime statistics. As a matter of policy, the professional counselors at the University of Dubuque are encouraged, if and when they deem it appropriate, to inform persons being counseled of the procedures to report crimes on a voluntary basis for inclusion into the annual crime statistics.
Pastoral Counselor: An employee of an institution, who is associated with a religious order or denomination, recognized by that religious order or denomination as someone who provides confidential counseling and who is functioning within the scope of that recognition as a pastoral counselor. Professional Counselor: An employee of an institution whose official responsibilities include providing psychological counseling to members of the institution's community and who is functioning within the scope of his or her license or certification.Most campus buildings and facilities are accessible to members of the campus community, guests, and visitors during normal hours of business, Monday through Friday, and for limited designated hours on Saturday, Sunday, and holidays. Facilities are maintained, and their security monitored, in the interest of students, staff, and faculty. Many cultural and athletic events held in University facilities, such as the Chlapaty Wellness Center, the McCormick and Stoltz Gym, Myers Teaching Administration Center, and Blades Hall, are open to the public. Other facilities such as the bookstore, library, chapel, and cafeterias are also open to the public. Access to academic and administrative facilities on campus is generally limited to students, employees, and visitors for the purpose of studying, working, teaching, and conducting other University business. Each academic building has established its hours based on the needs of specific academic departments. The University Safety and Security Department provides random patrols of all non-residential facilities 24 hours a day. All University of Dubuque halls are locked 24 hours per day.
The University of Dubuque Safety and Security Department staff strives to enhance security for campus facilities with the planned implementation of a state-of-the-art card access system and secondary locking devices. These systems help ensure that faculty, staff, and students with the proper authorization, are granted access to University resources after established business hours. Emergencies may necessitate changes or alterations to any posted schedules.
Family Housing and Off-Campus ResidencesThe on-campus family housing complexes are patrolled by the University Safety and Security Department regularly. Off-campus apartment complexes, townhouses/condominium communities, and other multi-family dwellings are not patrolled. Students must make an extra effort to be aware of their surroundings. This includes knowledge of the measures landlords have taken on behalf of resident safety.
Statement of Policy for Addressing Campus Law Enforcement Authority and Jurisdiction
The University of Dubuque has an on campus population of approximately 800 students. The University of Dubuque is both a center for higher education and a vibrant, active community. As with any community, criminal activity and emergencies do occur on campus. To combat crime and ensure public tranquility, the University Safety and Security Department is a visible part of campus life. The University Safety and Security Staff possesses the power and authority to issue parking citations in the city streets. However, the staff does not have authority to apprehend and arrest anyone involved in illegal acts on campus. The main function of the staff would be to observe and report any wrong doings to the local police department. The staff of the University Safety and Security Department is dedicated to ensuring that the campus is a safe environment for studying, teaching, researching, recreating, and living. Our department strives toward this goal through problem-solving partnerships with the faculty, staff, and students, as well as Dubuque Police, and our community's neighbors. The University's Safety and Security Department prides itself in its involvement with the Dubuque Police and the City of Dubuque, and in doing so are active members of The Dubuque Area Substance Abuse Coalition(D.A.S.A.C), Dubuque Alcohol Risk Reduction Committee, Dubuque Tobacco Coalition, and Member of the Safety and Security Committee for the City of Dubuque. The University Safety and Security Department in conjunction with the Student Life Department administers an aggressive program of regular inspection, testing and maintenance of University premises, to ensure compliance with applicable fire and life safety codes and standards. Conducting regular egress drills and providing a variety of educational and training programs for students, faculty and staff is also included.
Fire Alarm and Suppression SystemsThe University of Dubuque's on-campus housing consists of a variety of configurations, including traditional dormitory-style buildings, and homes acquired and renovated by the University. Each facility is equipped with the fire and life safety systems required by the building codes. Fire safety equipment is reviewed regularly to identify locations where enhancements such as additional sprinkler and smoke detection systems beyond those required by building codes are appropriate; plans for such enhancements are integrated into the university's annual facilities maintenance project plan.

Resident Life Department develops evacuation training and provides training for Residence Assistants during the annual RA training just prior to the beginning of the academic year. During student orientation, Resident Life provides a PowerPoint program entitled Campus Orientation for Public Safety for RA's which serves as the outline for this training and is posted to the Blackboard application of the Department of Residence Life as a resource for the student and professional staff of the Department throughout the year. This training includes instructions pertaining to evacuation immediately upon activation of any fire alarm.
The University's Safety and Security Department implements fire drills, regularly reviews evacuation plans for all on-campus residence halls, and ensures that evacuation plans are posted in each residence hall. Fire egress drills are scheduled at least once each semester and include guidance from Safety and Security Staff and Residence Life Staff so evacuating residents know where to safely assemble once outside the building.
Residents in on-campus housing are also provided with a variety of informational fire safety literature, provided by Resident Life, during the fall semester as periodic reminders of practicing sound fire safety principles. Among the specific information distributed are brochures entitled "What You Should Know - Fire Safety in University of Dubuque Residence Halls" and "Evacuation Guidelines for Deaf and Disabled Individuals."
Fires in On-Campus Residential FacilitiesFire alarms activated by the university's automatic alarm system or by persons reporting the presence of smoke result in an immediate response by Safety and Security Staff to investigate the cause of the alarm and contact the local Fire Department. In the case of an actual fire, an incident report is generated and a detailed record of the fire is maintained. A record of all fires in on-campus residence hall facilities is also included in the public log of crimes and other incidents maintained by the University Safety and Security Department, which is available for public viewing during normal business hours.
Anyone observing a fire in a residence hall should activate the nearest fire alarm, exit the building, and then contact the University Safety and Security Department at 3333 or 563-589-3333 immediately. Pull stations are typically located near doors leading to stairways and exits. Upon hearing a fire alarm, all occupants should evacuate the building by stairs and exits immediately. Federal law and Residence Life policy require staff members who discover evidence of a past fire which was extinguished before a fire alarm was activated to report their findings to the University Safety and Security Department. Such reports also result in an investigation and an entry being made in the public log.
During the three year reporting period covered by this report the following fires were reported in on-campus residence halls.
Fire Evacuation Procedures for Residence HallsAny employee, student, or visitor that becomes aware of a fire shall immediately activate the building fire alarm system. The fire alarm system will in turn notify all building occupants that a fire emergency exists. This is accomplished through sounding an audible alarm and visual flashing strobe lights. All employees, students, and visitors will regard any activation of a fire alarm as a true fire emergency unless there has been previous notification of the alarm system being tested.
Once you have safely evacuated the building, University Safety and Security must be contacted immediately at 3333 or (563) 589-3333 and notify the dispatcher that a fire alarm in the building has been activated. If the phone is not answered, call the Fire Department at 9-911 or 911 immediately.
All occupants will immediately leave the building utilizing the escape routes posted in hallways on each level. All alarms must be treated as warning of an actual emergency. Do not take time to get personal possessions. Any occupant who comes into contact with a student or visitor should direct them to evacuate the building. Any occupant that comes into contact with a visitor or student that is physically disabled should assist those individuals from the building (DO NOT USE ELEVATORS).
Building occupants should make exiting the building, not extinguishing the fire, their priority; attempts to extinguish the fire are not recommended.
Once out of the building, all occupants should assemble in the University Emergency Evacuation Building Assembly Area (see specific locations listed below). No student should leave the assembly area, either to re-enter the building or leave the campus, until advised to do so by the University Safety and Security Staff or by the Student Life Staff. Even if it's determined that someone is missing, no one should re-enter the building.

This procedure has been developed to provide assistance to mobility-impaired individuals when an emergency occurs and a building's elevator is unavailable. This procedure should also be used in cases where mobility impaired individuals may be on the upper floors of a building, or basement, and the elevator(s) have become inoperative. This procedure is not intended to be used to move a mobility impaired individual into a building.
In the event that an emergency occurs within a multi stored building, building occupants should be aware of any mobility impaired individuals living within the building.
If an emergency occurs (i.e., fire, severe storms), any student, faculty, or staff within the vicinity of the mobility impaired individual should immediately call the University Safety and Security Department 3333 or at (563) 589-3333 and advise the University Safety and Security Officer regarding the need for services. The caller should provide the following information:
The University Safety and Security Dispatcher will immediately send University Safety and Security Officer to assist the impaired individual.
Until the University Safety and Security Officer arrives, the initial caller should remain with the mobility impaired individual. If the emergency conditions worsen (i.e., the fire spreads to the floor that the impaired individual is located) two options remain:
The University Safety and Security Department believes that through crime prevention and safety awareness education, community members are better prepared to prevent crime and to respond if crime does occur. During New Student Orientation, students and their parents are informed of resources offered by the Safety and Security Department. They are informed of crime on-campus and in surrounding neighborhoods. Similar information is presented to new employees. Crime Prevention Programs and Sexual Assault Prevention Programs are offered on a continual basis by the Safety and Security and/or the Resident Life Departments. Periodically, during the academic year, the University of Dubuque Resident Life Department presents crime prevention awareness sessions on sexual assault (rape and acquaintance rape), as well as educational sessions on personal safety and residence hall security. A common theme of all awareness and crime prevention programs is to encourage students and employees to be aware of their responsibility for their own security and the security of others. In addition to seminars, information is disseminated to students and employees through crime prevention awareness displays.
Security CamerasThe University of Dubuque Safety and Security Department seeks to enhance public safety and security by utilizing security cameras, in a professional and ethical manner, consistent with acceptable legal rights and privacy.
Informing the Accuser and the Accused of the Outcome of a Disciplinary ProceedingThe Student Right to Know and Campus Security Act ,amended FERPA, allows institutions to disclose to the victim of an alleged crime of violence, the results of a disciplinary proceeding brought against a student accused of the crime, without the prior consent of the accused. This disclosure is limited to the alleged victim, who should be informed, that the information may not be disclosed to the public generally (20 U.S.C. Section 1232g (b) (6)).
Reporting Crimes Referred to a Disciplinary CommitteeAn institution is not relieved of compliance with the reporting requirements of the campus security regulations when the institution refers a matter to a disciplinary committee rather than to the institution's law enforcement unit or directly to the local authorities.
Substance abuse and its related consequences undermine the University of Dubuque's goals of academic success, student/ employee welfare, and safety. For this reason, the university has established policies and regulations pertaining to the possession and consumption of alcoholic beverages and the possession, use, distribution and sale of illegal drugs and paraphernalia. These standards conform to state and federal laws, and enhance the health, safety, property and educational interests of all members of the university community. Health risks associated with alcohol and other drug consumption include impaired judgment, vision, speech, coordination, memory, sensation and perception. Long-term use of alcohol and other drugs can negatively impact many of the body's systems, and cause physical and psychological dependence.
In accordance with the Drug-Free Schools and Communities Act, Amendments of 1989 (PL101-226 20 U.S.C. sec. 1145g), university regulations and laws pertaining to alcoholic beverages and the possession, use, distribution and sale of illegal drugs shall be strictly and consistently enforced. Any violation of the University's Code of Student Conduct or violation of federal, state or local laws shall subject the offender to the university disciplinary process and/or criminal prosecution.
This policy pertains to alcohol and other drug use behaviors in residence halls and university apartments. All members of the university community, including students not residing on campus, are responsible for obtaining and adhering to this policy while in university-approved building.
Alcohol Policy· No person under 21 years of age may possess, use or be under the influence of alcohol.
· Providing alcoholic beverages to a person under age 21, whether gratuitously or for sale is prohibited.
· Intoxication, defined as being under the influence of alcohol or other drugs, is prohibited for students and employees on campus.
· Quantity-dispensing containers, including but not limited to kegs, punch bowls and beer balls, are prohibited.
· Drinking funnels, taps, ice luges or similar devices are prohibited.
· Drinking games or other activities involving rapid and/or excessive consumption are prohibited. Creating, offering, and playing drinking games such as beer pong are considered endangering behaviors and are prohibited.
· Possession of alcohol containers, whether empty or full, is prohibited.
· On campus university events prohibit serving alcohol unless prior approval is received.
· The University of Dubuque is a dry campus, and drinking or having possession of alcohol at any time without prior approval is prohibited.
Drug PolicyPer Chapter 94C, Section 32L. "Notwithstanding any general or special law to the contrary, possession of one ounce or less of marihuana shall only be a civil offense, subjecting an offender who is eighteen years of age or older to a civil penalty of one hundred dollars and forfeiture of the marihuana, but not to any other form of criminal or civil punishment or disqualification. An offender under the age of eighteen shall be subject to the same forfeiture and civil penalty provisions, provided he or she completes a drug awareness program which meets the criteria set forth in Section 32M of this Chapter. The parents or legal guardian of any offender under the age of eighteen shall be notified in accordance with Section 32N of this Chapter of the offense and the availability of a drug awareness program and community service option. If an offender under the age of eighteen fails within one year of the offense to complete both a drug awareness program and the required community service, the civil penalty may be increased pursuant to Section 32N of this Chapter to one thousand dollars and the offender and his or her parents shall be jointly and severally liable to pay that amount."
Unlawful possession of a controlled substance is prohibited, as defined by Chapter 94C, Section 32, which states "no person knowingly or intentionally shall possess a controlled substance, unless such substance was obtained directly, or pursuant to a valid prescription or order; from a practitioner while acting in the course of his professional practice, or except as otherwise authorized by the provisions of this chapter." Penalties include imprisonment for up to five years or a fine of not more than $5,000, or both a fine and imprisonment depending on the class of drug and offense.
Drug paraphernalia used with controlled substances is prohibited, as defined by Chapter 94C, Section 32, which states "no person shall sell, possess with intent to sell, or manufacture with intent to sell drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, package, repackage, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled substance." Determination of whether an item is drug paraphernalia will be made considering all relevant facts, including, but not limited to, the proximity of the item to the controlled substances. Penalties include imprisonment and/or fines.
Unauthorized possession of a hypodermic syringe or needle, or any instrument adapted for the administration of controlled substances by injection is prohibited, as defined by 94C, Section 27.
Unlawful sale/distribution/manufacture of controlled substances is prohibited, as defined by 94C, Section 32, which states, "any person who knowingly or intentionally manufactures, distributes, dispenses or possesses with intent to manufacture, distribute or dispense a controlled substance in Class A of section thirty-one shall be punished by imprisonment in the state prison for not more than ten years or in a jail or house of correction for not more than two and one-half years or by a fine of not less than one thousand nor more than ten thousand dollars, or by both such fine and imprisonment."
Good Samaritan ProtocolSevere intoxication or serious injuries after consuming alcohol or drugs are potentially life-threatening emergencies. Although individuals may be reluctant to report these situations, obtaining medical help is imperative. The University's Good Samaritan Protocol can mitigate potential judicial consequences, ensuring that health and safety remain our community's top priority. An individual who assists a person who requires medical attention due to excessive alcohol or drug intoxication may not face judicial consequences.
The University educates the student community about sexual assaults and date rape through mandatory freshman orientations each fall. The University of Dubuque's Resident Life Department offers sexual assault education and information programs to University students, and the Human Resources Department provides it to employees upon request. Literature on date rape education, risk reduction, and University response is available through the Office of Resident Life and the Human Resources Department. Anyone who is a victim of a sexual assault should make getting to a place of safety his/her first priority, and once safety has been established obtain necessary medical treatment. The University Safety and Security Department strongly advocates that a victim of sexual assault report the incident immediately. Once reported, the victim will receive the necessary medical treatment and tests as well as free confidential counseling from counselors specifically trained in the area of sexual assault crisis intervention.
Sexual assault is any type of sexual contact that takes place without consent; it's a crime of violence and control that can happen to anyone. The Dubuque Department of Public Health trains, certifies and supports registered nurses and physicians to provide quality care and collect forensic evidence pertaining to sexual assaults. Victims who have been sexually assaulted or abused and whose primary language is not English can work with (trained interpreters) who will accompany the Counselor/Advocates. The interpreters can help with telephone communication, counseling, and advocacy, allowing Victims/Survivors to address their feelings as well as their logistical needs in their native languages.
If a University of Dubuque student who is a victim of sexual assault or relationship violence requests a change in her or his living arrangements or academic schedule, the Dean of Students Office and the Office of Residence Life will assist the student in making changes to the student's living or academic arrangements as long as those changes are reasonably available.
The Federal Campus Sex Crimes Prevention Act requires colleges and universities to issue a statement advising the campus community of obtaining information concerning registered sex offenders. The act also requires registered sex offenders to provide to appropriate state officials, notice of each institution of higher education in the state in which the offender is employed, carries on a vocation, or is a student.

Penalties for Improper Use of Sex Offender Registry InformationInformation contained in the Sex Offender Registry shall not be used to commit a crime against an offender or to engage in illegal discrimination or harassment of an offender. Any person who improperly uses Sex Offender Registry information shall be punished by not more than two and one-half years in a house of correction or by a fine of not more than $1,000, or by both fine and imprisonment.
Sex Offenses Defined as per the National Incident-Based Reporting System Edition of the Uniform Crime Reporting Program Sex Offenses-Forcible : Any sexual act directed against another person, forcibly and/or against that person's will; or not forcibly or against the person's will where the victim is incapable of giving consent.The carnal knowledge of a person, forcibly and/or against the person's will; or not forcibly or against the person's will where the victim is incapable of giving consent because of his/her temporary or permanent mental or physical incapacity (or because of his/her youth).
Oral or anal sexual intercourse with another person, forcibly and/or against that person's will; or not forcibly against the person's will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity.
The use of an object or instrument to unlawfully penetrate, however slightly, the genital or anal opening of the body of another person, forcibly and/or against that person's will; or not forcibly or against the person's will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity.
The touching of the private body parts of another person for the purpose of sexual gratification, forcibly and/or against that person's will; or, not forcibly or against the person's will where the victim is incapable of giving consent because of his/her youth or because of his/her temporary or permanent mental or physical incapacity.
Sex Offenses-Non-Forcible : Unlawful, non-forcible sexual intercourse.Non-forcible sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law.
Non-forcible sexual intercourse with a person who is under the statutory age of consent.
1. Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of or in a manner related to the institution's educational purposes, including residence halls;
2. Any building or property that is within or reasonably contiguous to the area identified in paragraph (1), that is owned by the institution but controlled by another person, is frequently used by students and supports institutional purposes (such as a food or retail vendor).
Non-Campus Building or Property-Defined as :1. Any building or property owned or controlled by a student organization that is officially recognized by the institution;
2. Any building or property owned or controlled by an institution that is used in direct support of or in relation to the institution's educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution.
